Are You Using the Correct I-9 Form?

Despite the many changes to labor and employment law – as well as our day-to-day lives and society as a whole – that COVID-19 has brought about in the last two months, there are still non-COVID-19 developments in labor and employment law that Human Resources professionals and business owners must be aware of. For example, use of the new I-9 Form, which was issued on January 31, 2020, became mandatory on May 1, 2020. Copies of the new I-9 Form can be found here: https://www.uscis.gov/i-9. Failure to use the new I-9 Form when onboarding new hires can result in fines and penalties under the Immigration and Naturalization Act.

To assist employers with their obligations using the new I-9 Form, U.S. Citizenship and Immigration Services (“USCIS”) issued an updated “Handbook for Employers — Guidance for Completing Form I-9” (also known as the M-274 Handbook).
